Welcome to kMap, a scalable real-time report management, information and control system that integrates multiple technologies to improve the flow of critical knowledge and key data and to improve its dependability. We’re also known as (aka) kMapReports but we Trade as kMap. We’re an Irish company, with US and UK offices and in this document, we’ll refer to Ourselves as (“kMap, “We,” “Our” or “Us”).

This Service Agreement, comprising of our General Service Level Agreement, Service Terms and Conditions of Use are intended to explain Our obligations as a service provider and Your obligations as a user of Our Service, we’ll refer to You as (“You,” or “Your”) throughout this document. They are in addition to any Terms agreed to in an Order Form if you have contracted directly to us. They are binding on any use of the Service and apply to You from the time that We provide You with access to the Service. Please read them carefully.

The kMap Service will evolve over time based on user feedback and Our Product Roadmap and Corporate Strategy. These Terms are not intended to answer every question or address every issue raised by the use of Our Service. We reserve the right to change these terms at any time, effective upon the posting of modified terms. We will make every reasonable effort to communicate these changes to You via notification or via Our Service. It is likely the terms of use will change over time. It is Your obligation to ensure that You have read, understood and agree to the most recent terms available on the Website.

By registering to use the Service You acknowledge that You have read and understood these Terms and have the authority to act on behalf of any person, company or organisation for whom You are using the Service. Your use of Our website, the services made available via this Site, and access to services via API (together “Services”) are all subject to these Terms of Service (these “Terms”). By using any of Our Services, You agree to be bound by, and use Our Services in compliance with, these Terms. If You do not agree to these terms, do not use Our services.

Duration of Agreement

This Agreement starts on the commencement date per Your Order, captured in the Order Form and continues for the period set out in the Order Form (unless terminated earlier in accordance with its terms), or from the time that You start using the Service for as long as You use the Service.

kMap Obligations

We shall: (a) make the Service available during the Term to the Subscriber and its customers in accordance with the Documentation and any applicable additional SLA; (b) provide the Additional Services to the Subscriber in accordance with these terms and the relevant Order Forms; (c) not use Subscriber Data except to provide the Service, or to prevent or address service or technical problems, and (d) not disclose Subscriber Data to anyone other than authorised parties.
As part of Our continuing innovation, You acknowledge and agree that We may stop (permanently or temporarily) providing the Services (or any features within the Services) to You or to users generally at Our sole discretion, without prior notice to You.
You acknowledge and agree that if kMap disables access to Your account, You may be prevented from accessing the Services, Your account details or any files or other content which is contained in Your account.
You acknowledge and agree that while kMap may not currently have set a fixed upper limit on the number of transmissions You may send or receive through the Services or on the amount of storage space used for the provision of any Service, such fixed upper limits may be set by kMap at any time, at Our discretion.

Your Obligations

You are responsible for all use of the Service by You, Your employees and sub-contractors. You shall: (a) have sole responsibility for the accuracy, quality, and legality of all of Your Data, and (b) prevent unauthorized access to, or use of, the Service, and notify kMap promptly of any such unauthorized access or use, and c) shall indemnify kMap against any claims made by third parties in relation to materials uploaded by You to the kMap Service. In order to access certain Services, You are required to provide information about Yourself (such as identification or contact details) as part of the registration process for the Service, or as part of Your continued use of the Services. You agree that any registration information You give to Us will always be accurate, correct and up to date.

Usernames and Passwords: You are responsible for maintaining the confidentiality of Your username and password, and are solely responsible for all activities that occur thereunder. You agree (i) not to allow a third party to use Your account, usernames or passwords at any time; and (ii) to notify kMap promptly of any actual or suspected unauthorized use of Your account, usernames or passwords, or any other breach or suspected breach of this Agreement.

Accounts and Access.The Subscriber determines who is an Invited User and what level of user role access to the relevant organisation and Service that Invited User has; the Subscriber is responsible for all Invited Users’ use of the Service; the Subscriber controls each Invited User’s level of access to the relevant organisation and Service at all times and can revoke or change an Invited User’s access, or level of access, at any time and for any reason, in which case that person or entity will cease to be an Invited User or shall have that different level of access, as the case may be; if there is any dispute between a Subscriber and an Invited User regarding access to any organisation or Service, the Subscriber shall decide what access or level of access to the relevant Data or Service that Invited User shall have, if any. Back of Data. You should maintain copies of all Data in-putted into the Service. We adhere to best practice policies and procedures to prevent data loss, but do not make any guarantees that there will be no loss of Data. We expressly exclude liability for any loss of Data no matter how caused.
